The firm acts at every stage of real estate seizure proceedings: securing your debt through mortgage registration; selling property at auction — mainly for banks — before the Draguignan court or any court within the Aix-en-Provence Court of Appeal; representing the seized debtor (representation by counsel is compulsory; only a lawyer may raise objections by the orientation hearing, notably the two-year limitation of the bank's action); and helping you buy at auction. Auctions are open to everyone: bids are placed through a lawyer, and our firm can bid on your behalf. Properties are advertised one to two months before the sale and bailiff-organised visits are held — visit before bidding, as properties are sold as-is with no hidden-defect warranty. To bid, provide a bank cheque or irrevocable guarantee of 10% of the reserve price (minimum €3,000), a special power of attorney and identity documents. Payment is due within two months; costs include prosecution fees, lawyer's emoluments (2.5%) and registration duties (~7%). There is no loan condition precedent. Any person may over-bid by at least 10% within ten days. The adjudication judgment is an eviction title against the seized debtor.
