The firm regularly handles contested and uncontested divorce proceedings. French law provides four types of divorce: by mutual consent — now possible by private deed countersigned by lawyers and filed with a notary (art. 229 Civil Code); for fault; by acceptance of the breakdown of the marriage; and for definitive alteration of the marital bond. The firm has also specialised in court-ordered auction sales (licitation) of jointly owned property, to divide post-marital or inheritance co-ownership: no one can be forced to remain in joint ownership (art. 815 Civil Code). A simplified procedure exists where co-owners holding at least two-thirds of the rights declare their intention before a notary; otherwise a contentious action for partition and sale must be brought against all co-owners, with strict admissibility requirements (art. 1360 CPC). The sale then takes place at court, with bids placed through a lawyer, on the basis of sale conditions filed with the enforcement judge.
